Are hemp derived Delta 9 drinks legal?

Relax, chill, of course they are! All of our Green Monké drinks are federally legal in the United States under the Farm Bill. Not only does the federal legislation support the processing, sales and distribution of hemp derived products, many states have specifically adopted the Farm Bill legislation.

What is the Farm Bill?

The Agriculture Improvement Act of 2018, commonly known as the Farm Bill, has had a major impact and has lead to a significant shift in the legal treatment of hemp in the United States.

Why is the Farm Bill important?

The Farm Bill removes hemp, hemp products and hemp-derived products from the list of controlled substances. This means that the Farm Bill has effectively legalized the cultivation, processing, and sale and transportation of hemp in all its forms across state lines.

What is the definition of hemp?

The Farm Bill defines hemp as cannabis plants and derivatives containing no more than 0.3% THC (tetrahydrocannabinol), the psychoactive compound found in cannabis. This crucial distinction separates hemp from cannabis (referred to as marijuana in U.S. legislation), which remains a controlled substance under federal law.

How does the Farm Bill legalize hemp derived products?

US courts have repeatedly and consistently confirmed the legality of hemp-derived products through multiple rulings. Although the Farm Bill clearly removed hemp-derived products from the list of controlled substances in 2018, the industry did not take off until many courts across multiple states ruled that hemp-derived products were not illegal, could be sold online and through traditional retail stores, can be transported across state lines, and are subject to trademark protection. Indeed, the landmark case that really launched the industry was in May 2022, when the Ninth Circuit Court of Appeals protected a brand of hemp-derived vape pens from counterfeits.

What states have passed legislation supporting the Farm Bill?

More than 35 states have passed legislation adopting the Farm Bill in their state, including Texas, Florida, and Georgia. The fact that these states have specifically adopted the hemp-derivative definition from the Farm Bill despite typically being more conservative jurisdictions is another indication that the hemp-derivative industry has arrived and is here to stay!
